Welcome to OcuraLife. These Terms of Service ("Terms") govern your access to and use of the website located at https://ocuralife.com and any related content, features, products, and services (together, the "Service"). The Service is operated by RMDSD INC, a corporation registered in the Province of Québec, Canada ("OcuraLife", "we", "us", or "our"). OcuraLife is a proprietary trademark of RMDSD INC.

By accessing, browsing, or purchasing through the Service, you agree to be bound by these Terms and by our Privacy Policy, Refund and Returns Policy, Shipping Policy, and Safety Information page, each of which is incorporated into these Terms by reference. If you do not agree to these Terms, you may not access or use the Service.

1. Eligibility and Age Requirement

OcuraLife products are intended for adults only. You must be at least 18 years of age, or the age of majority in your province, state, or country of residence if that age is higher, to create an account or place an order. By using the Service, you confirm that you meet this requirement.

OcuraLife devices and treatments are not intended for use by minors, and you may not purchase any product on behalf of a minor. Additional health-related restrictions on who should not use our products are set out on our Safety Information page at https://ocuralife.com/pages/safety.

2. Account Registration

Some features of the Service may require you to create an account. When you create an account, you agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Please notify us immediately at support@ocuralife.com if you suspect any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

3. Cosmetic Use and Health Disclaimer

OcuraLife sells cosmetic skincare devices and topical products intended for use on benign, surface-level skin imperfections.

The services, information, and products mentioned or written about on the Service are intended solely for informational, educational, and cosmetic purposes. The words, statements, and claims on the Service are not designed to diagnose, treat, cure, or prevent any disease or health condition, and have not been verified by local authorities, health departments, or government bodies.

OcuraLife products are not medical devices and are intended for benign, cosmetic concerns only. If a skin spot changes in color, size, shape, or border, or if you are unsure whether a concern is benign, do not use any OcuraLife product and consult a licensed healthcare professional. You are responsible for determining whether an OcuraLife product is appropriate for your skin and health. You must read the Safety Information page at https://ocuralife.com/pages/safety in full before purchasing or using any product. Individual results vary and are not guaranteed.

4. Products, Pricing, and Availability

All orders placed through the Service are offers to purchase and are subject to our acceptance. We may, at our discretion, refuse, limit, or cancel any order, including orders that appear to be placed by resellers, orders that fail address or payment verification, and orders affected by a pricing or product description error.

All prices are listed in the currency shown at checkout and are subject to change without notice. We make reasonable efforts to display products, pricing, and promotional offers accurately, but we do not warrant that all content on the Service is current or error-free. If a product is listed at an incorrect price, we reserve the right to cancel the order and refund any amount charged.

Product availability may change at any time, and we reserve the right to discontinue any product. Promotional offers, discount codes, and sale pricing are subject to their own stated terms, may be modified or withdrawn at any time, and may not be combined unless expressly stated.

5. Payment

Payments are processed by our third-party payment providers, which may include Shopify Payments, Shop Pay, and Shop Pay Installments. By submitting payment information, you represent that you are authorized to use the selected payment method. Installment financing, where offered, is provided by a third-party lender and is subject to that lender's separate terms. We do not store full payment card details.

6. Shipping, Returns, and Warranty

Shipping timelines, costs, and delivery terms are described in our Shipping Policy at https://ocuralife.com/policies/shipping-policy. Returns, refunds, the 90-day money-back guarantee, and the store-credit option are described in our Refund and Returns Policy at https://ocuralife.com/policies/refund-policy. OcuraLife devices are covered by a one-year limited warranty against manufacturing defects, as described in the Refund and Returns Policy. Those policies form part of these Terms.

7. Intellectual Property

The Service and all of its original content, features, and functionality, including text, graphics, logos, images, video, and software, are and will remain the exclusive property of RMDSD INC and its licensors, and are protected by copyright, trademark, and other laws of Canada, the United States, and other countries. The OcuraLife name, logo, and branding may not be used in connection with any product or service without our prior written consent.

8. User Content

The Service may allow you to submit content such as product reviews, photographs, comments, or other material ("User Content"). You are responsible for your User Content, including its legality, accuracy, and appropriateness.

You retain ownership of your User Content. By submitting it, you grant OcuraLife a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, adapt, publish, and display that content in connection with operating and marketing the Service. You represent that you own or have the necessary rights to the User Content you submit and that it does not infringe the rights of any third party. We may remove any User Content at our discretion.

9. Prohibited Activities

You agree not to:

  • Use the Service in any manner that could disable, overburden, damage, or impair it.
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems.
  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Resell, or purchase for the purpose of reselling, OcuraLife products without our written authorization.
  • Submit or transmit any content that is false, defamatory, abusive, obscene, infringing, or otherwise harmful.
  • Use any robot, scraper, or other automated means to access the Service, except for standard search engine indexing.

10. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by OcuraLife, including affiliate, partner, and order-tracking services. We are not responsible for the content, policies, or practices of any third-party site or service. Your use of third-party sites is at your own risk and is subject to their terms.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, except those that cannot be excluded under applicable law. OcuraLife does not warrant that the Service will be uninterrupted, timely, secure, or error-free. Any product-related warranties are limited to those expressly stated in our Refund and Returns Policy and Safety Information page.

12. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall OcuraLife, RMDSD INC, or their directors, officers, employees, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:

  • Your access to, use of, or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your mandatory rights as a consumer.

13. Indemnification

You agree to defend, indemnify, and hold harmless OcuraLife, RMDSD INC, and their affiliates, directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses, including reasonable legal fees, arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including any copyright, property, or privacy right.
  • Any claim that your User Content caused damage to a third party.

This obligation survives termination of these Terms and your use of the Service.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable in that province, without regard to conflict-of-law principles. Nothing in this section deprives you of the protection of the mandatory consumer protection laws of your place of residence.

15. Dispute Resolution

If you have a concern or dispute with OcuraLife, you agree to first contact us at support@ocuralife.com and give us a reasonable opportunity to resolve it informally. Most issues can be resolved quickly this way.

If a dispute cannot be resolved informally, and subject to the mandatory consumer protection laws of your place of residence, you agree that any claim or dispute arising out of or relating to these Terms or the Service shall be brought exclusively before the courts located in the Province of Québec, Canada, and you and OcuraLife consent to the personal jurisdiction of those courts.

Nothing in these Terms requires you to give up any right or remedy that cannot lawfully be waived in your jurisdiction, including any right to bring a claim before a consumer protection tribunal or small claims court where available.

16. Changes to These Terms

We may modify these Terms at any time. If a change is material, we will post the updated Terms on the Service and update the "Last updated" date, and where required by law we will provide additional notice. Changes take effect when posted unless stated otherwise. Your continued use of the Service after revised Terms become effective constitutes acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Service.

17. Termination

We may suspend or terminate your access to the Service at any time, without prior notice or liability, if you breach these Terms or if we reasonably believe your use of the Service poses a risk to OcuraLife, other users, or third parties. Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnification, will survive.

18. Force Majeure

OcuraLife is not liable for any failure or delay in performing its obligations where the failure or delay results from any cause beyond its reasonable control, including natural disasters, labor disputes, carrier or supplier delays, and mechanical, electronic, or communications failures.

19. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and OcuraLife regarding the Service and supersede any prior agreements between us regarding the Service.

20. SMS and MMS Marketing Program

OcuraLife offers an optional SMS and MMS marketing program (the "Program"). Participation is voluntary, and consent to receive messages is not a condition of any purchase.

By opting in, for example through an online enrollment form, a checkout checkbox, or by texting a keyword, you consent to receive recurring automated marketing text messages from or on behalf of OcuraLife at the mobile number you provide, including messages about products, offers, and promotions.

Message frequency varies. Message and data rates may apply, depending on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages. To participate, you must be at least 18 years of age and be the account holder of, or an authorized user of, the mobile number provided.

You may opt out at any time by replying STOP to any message. You may receive one final message confirming your opt-out. For help, reply HELP or contact us at support@ocuralife.com. Your participation in the Program is also governed by our Privacy Policy. We may modify or end the Program at any time.

21. Privacy

Your use of the Service is also governed by our Privacy Policy, available at https://ocuralife.com/policies/privacy-policy, which explains how we collect, use, and disclose your personal information. Please review it carefully.
